Centre for Legal and Comparative Studies

The Centre for Legal and Comparative Studies was established at Karaganda University “Bolashak” in September 2009. The Centre’s activity is carried out in accordance with the Development Strategy of the Republic, formulated in the Messages of the President of the Republic of Kazakhstan in the field of combating crime, the current legislation, the concept of legal policy in the Republic of Kazakhstan for the period from 2010 to 2020, orders and instructions of the Ministry of Education and Science of the Republic of Kazakhstan on the organization of research work in universities.

The purpose of the Centre is to unite the efforts of scientists and legal practitioners to develop new doctrinal approaches to improve legislation that meets modern needs. Involvement in a scientific turn of results of scientific researches of scientists-lawyers of the CIS countries by their participation in scientific actions spent by the center, the edition of monographs, textbooks, manuals. Creation of opportunities for prompt exchange of the scientific results obtained and development of common approaches on its pages. Creation of new jobs in the field of science.

The Centre for Legal and Comparative Research carries out fundamental and applied scientific research in priority areas of legal support of socially oriented market economy and formation of civil society, research of actual problems of struggle against crime and provision of effective measures of influence on it, improvement of national legislation, activity of law enforcement bodies, provision of interaction of educational and scientific organizations with public authorities and local authorities.

The main activities of the Centre are as follows:

Organization and holding of round tables on the most pressing issues of theory and practice of legislation application with participation of leading scientists, representatives of legislative, executive and judicial authorities, public organizations and development of other forms of research cooperation;

Preparation of expert legal opinions on the most complex issues of the application of legislation, including the determination of the legality and validity of decisions taken by public authorities and local authorities, as well as judicial decisions;

participation in the discussion of draft laws and resolutions of the Government of the Republic of Kazakhstan and preparation of proposals on bringing them into conformity with the Constitution of the Republic of Kazakhstan and exclusion of norms with a corruption component from their content and development of proposals on their improvement with involvement of a wide range of scientific community;

consolidation of efforts of the most talented youth from among students, undergraduates, doctoral candidates of law schools and creation of conditions for their active participation in scientific activity of scientific research institutes, including at preparation of theses, master’s and doctoral dissertations;

participation in competitions for grant funding of scientific research.

Tasks:

Consolidation of efforts of scientists, teachers, legal practitioners to address specific scientific and educational projects in the field of law;

creation of information, educational, methodological and scientific basis for their subsequent use in the educational process and scientific research;

examination of draft laws;

elaboration of proposals on strengthening the rule of law in the sphere of law enforcement;

study of the practical activities of law enforcement agencies in combating crime and dissemination of positive experience in their work;

scientific substantiation of the basic directions, forms and ways of interaction of law enforcement bodies with other state bodies, public organizations in the field of struggle against crime;

conducting sociological research in the field of combating crime in the Republic as a whole and in individual regions;

Providing methodological assistance to researchers and practitioners engaged in research in the field of combating crime;

Testing the results of research through the organization and holding of conferences and round tables (scientific-theoretical, scientific-practical, etc.) and discussion of current problems in combating crime in the mass media and special publications;

conducting reference and bibliographic work on the problems of fighting crime;

preparation of scientific and educational literature (monographs, textbooks, reference and training manuals);

preparation and publication of scientific articles in journals with a non-zero impact factor;

implementation of publications in foreign peer-reviewed scientific journals;

review and analysis of judicial and investigative practice materials.

Areas of activity of the Centre:

The fundamental direction of scientific research is the problem of determining the necessary costs of the state to ensure the security and functioning of law enforcement agencies, taking into account the laws of crime and global trends in its economic impact on the state and society.

Applied directions of scientific research:

Improvement of housing legislation and housing policy in the Republic of Kazakhstan;

problems of the fight against crime.

Composition of the Centre for Legal and Comparative Research:

Nurgaliev B.M.

The Research Institute for Legal and Comparative Studies is headed by an honorary member of the National Academy of Sciences of the Republic of Kazakhstan, Doctor of Law, Professor B.M. Nurgaliev, who has extensive practical experience in the investigative units of the internal affairs agencies. As a forensic specialist, he makes a huge contribution to the legal science of Kazakhstan. He wrote more than 120 published textbooks, teaching aids, monographs and methodical aids, he participated in development of criminal and criminal procedure codes of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan “On fight against corruption”.

On his initiative, the first Dissertation Council was established at Barimbek Beisenov Karaganda Law Institute of the Ministry of Internal Affairs of the Republic of Kazakhstan in 2000, which he headed for nine years. Under his leadership 29 candidate’s and 2 doctoral dissertations were defended.

For many years of impeccable service in the internal affairs bodies, a great contribution to the training of highly qualified specialists for the law enforcement agencies of the country, high achievements in research activities B.M. Nurgaliyev was awarded the breastplate “Honored Worker of the Ministry of Internal Affairs”.

In February 2013, B.M. Nurgaliev was elected an honorary member of the National Academy of Sciences of the Republic of Kazakhstan.

In 2013-2015 Nurgaliyev was the scientific adviser of the grant financing theme of the Ministry of Education and Science of the Republic of Kazakhstan “Crime and criminality: criminological and economic-legal aspects of the price”.

Arystanbekov M.A.

Doctor of Law, Associate Professor Arystanbekov M.A. – leading research fellow of the research institute of legal and comparative studies, graduated from the Karaganda State University named after E.A. Buketov. He studied at the Academy of Management of the Russian Interior Ministry. Has worked 27 years in bodies of

internal affairs of the Republic of Kazakhstan. Has practical work experience as an investigator and significant scientific and pedagogical experience.

The area of scientific research is criminal procedure law, criminalistics, operatively-search activity and forensic examination. It has over 70 scientific publications. The main scientific works are devoted to the problems of methods of prevention, disclosure and investigation of crimes. They have made a certain contribution to the development of various problems of criminalistics, related to the theoretical provisions of science, the development and application of tools and methods of forensic technology, the tactics of individual investigative actions, planning of investigation, development of methods of investigation of individual types of crime, the improvement of tactical techniques and technical and forensic means.

Specialist in the field of criminal procedure and criminalistics, author of a number of scientific works related to the forensic support of criminal proceedings.

Lakbaev K.S.

Doctor of Law K.S. Lakbaev is engaged in development of operatively-search problems of influence on crime in the republic. He has rich practical experience of work in the bodies of internal affairs, on defense of dissertations for the degree of Doctor of Juridical Sciences.

The field of scientific interests: operatively-search legislation of the Republic of Kazakhstan, theory and practice of operatively-search activity of bodies of internal affairs, including: struggle against organized crime, drug business, religious extremism and terrorism, operatively-search psychology, methods of training of personnel for operative apparatuses of bodies of internal affairs, foreign experience in struggle against especially dangerous displays of crime, etc. He has about 60 scientific works.

He is an expert in the field of operatively-search activity, criminal process and criminalistics, the author of a number of scientific works connected with reforming of law-enforcement system, and also scientific publications devoted to struggle against organized crime.

A.K. Kusainova.

Candidate of Legal Sciences, Associate Professor A.K. Kusainova. In 1999 she graduated from the Law Faculty of D.A. Kunayev University. From 1999 to 2002 she worked there as a lecturer, then as a senior lecturer. Since 2002, she worked at the Karaganda Law Institute of the Ministry of Internal Affairs of the RK named after B. Beisenov as a researcher, senior researcher of the research and editorial and publishing work department. From 2006 to 2008, she worked first as an associate professor at the Civil Law Department of the Academy of the Ministry of Internal Affairs of the RK, and from 2008 to 2010 in the same position at the Karaganda Law Institute of the Ministry of Internal Affairs of the RK named after B. Beisenov.

Sphere of academic interests: housing law issues, property rights, enforcement of obligations, etc. He has more than 100 published works in scientific publications of the Republic of Kazakhstan, Russia, Kyrgyz Republic, Ukraine, Moldova.

Grant research with the funds of the Ministry of Education and Science of the Republic of Kazakhstan.

During three years 2013-2015, the staff of the Centre for Legal and Comparative Studies carried out scientific research on the theme: “Crime and crime: criminological and economic and legal aspects of the price”, funded by the MES RK (grant funding). For 2013-2015 the centre achieved certain successes in research of a scientific problem that in turn has positively influenced scientific innovative activity and development of scientific potential of university.

The scientific research had first of all applied value, i.e. its results were widely demanded by law enforcement agencies. So, by results of research 11 acts of introduction from the Ministry of Internal Affairs of RK, DVD of Karaganda region and DVD of Kostanay region and other state structures were received.

The scientific production prepared by the author’s team is actively used in profile higher educational institutions of the Ministry of Internal Affairs of RK in the educational process of the postgraduate education department for doctoral candidates (PhD) and master’s students, as well as in the process of research activities for the preparation of scientific papers.

The results of research were tested at scientific events organized and conducted by the NTs legal and comparative research of the Academy “Bolashak” as part of the research theme. These are 2 international scientific-practical conferences and a round table. In total, the conferences were attended by about 100 participants.

Presentations made by the authors of the research at authoritative international conferences in near and far abroad received a great resonance. The most active

participants were Prof. B.M. Nurgaliev (Belgrade (Serbia), Moscow (Russia), St. Petersburg (Russia) and others).

The grant financing allowed the authors of the project to publish 11 articles in the highly rated journals with a non-zero impact factor, included in the database of Scopus and Thomson Reuters.

In total, the authors published more than 80 scientific articles on the topic of the study, 15 of them in journals recommended by the CCSON RK and indexed by the RRC.

Much work was done to survey citizens and law enforcement officials in three cities of Kazakhstan.

Employees of the National Centre for Legal and Comparative Studies actively participate in competitions for grant funding, both the Ministry of Education and Science of the Republic of Kazakhstan and private foundations and organizations. Thus, in 2014, 4 scientific projects were prepared for participation in the contest of the Ministry of Education and Science of the Republic of Kazakhstan and 2 scientific projects for participation in the contest in a private foundation. Work in this area is continuing.

On January 27, 2016 at the Academic Council of the Academy “Bolashak” the final report on grant funding was heard. The Academic Council noted the high quality of work of the Centre for Legal and Comparative Studies, significant results in the study of the fundamental theme “Crime.
