A guest lecture was held at the Bolashaq Academy in Karaganda, organized as part of improving the legal literacy of students and teachers. The lecture was conducted by the judges of the district court no.2 Kazybekbiysky district of Karaganda: Alzhanova Asem Beisembekovna, Bayankenova Mira Toleutaevna and Telgozhinova Zhanar Serikovna. The lecture course was devoted to the topic of mediation, a modern dispute resolution tool that plays a key role in the judicial system of Kazakhstan.
The judges said that initially mediation was perceived as an alternative to litigation, but over time this form of dispute resolution has become increasingly important in the legal system of Kazakhstan. In 2011, the Law of the Republic of Kazakhstan “On Mediation” was adopted, which became an important step towards creating a legal and organizational framework for the development of mediation in the country.
Mediation is a process in which a neutral mediator helps the parties to a conflict come to an understanding and an agreed solution. The judges stressed that the mediation process is focused on reaching a peaceful agreement between the parties, taking into account their interests, which makes it more flexible and effective compared to judicial proceedings.
Mediation is an important tool in the justice system of Kazakhstan, which helps to reduce the burden on the courts and contributes to the peaceful resolution of disputes. However, for the full functioning of the mediation institute, it is necessary to continue working to raise awareness of citizens, train mediators and improve legislation.
